Penal Code Article 202 bis (Decree 57-2002) criminalises discrimination on grounds such as gender, race, ethnicity, religion and disability, but not sexual orientation or gender identity, and enforcement is weak.

Foreign students must obtain a student temporary-residence permit from the Guatemalan Migration Institute (IGM) under the Migration Code (Decree 44-2016); tourist entry is limited to 90 days, within which residence must be regularised, and IGM verifies the declared address.
Student work rights
A student residence permit does not by itself grant the right to work; employment requires a separate labour clearance from the Ministry of Labour (MINTRAB) plus IGM authorisation under Decree 44-2016.
